The terms and conditions below apply in the case of sales of goods made from this website. Our terms and conditions for purchases made in our Glasgow store, over the phone, by mail or any other means will likely differ and should be referred to separately.

Our terms and conditions were amended in June 2014 in order to effect some changes in the Consumer Contract Regulations 2013 which have replaced the Distance Selling Regulations 2000.

Statutory Rights

Nothing in these Terms and Conditions shall affect your statutory rights under the law of Scotland. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions.

How the contract is formed between you and McLaren’s

After placing an order, you will immediately receive an email from us acknowledging that we have received your order – this is not an acceptance, simply an acknowledgement of your order.

All orders are subject to acceptance by us, we will confirm acceptance to you by sending an email at which time the contract between us will be formed and we will confirm delivery and payment details.

Where possible we have tried to indicate the availability for all products. This is not a live status of current stock availability and, in some circumstances, products indicated as in stock may not be available from stock at the time of receipt of the order by us. Nevertheless we will contact you to inform you of this.

Payment

You can pay for your purchases with MasterCard and Visa credit and debit cards.  All purchases are in pounds sterling.

Your security

We take your security seriously – when you give us your personal information and payment details they will be securely encrypted before they are transmitted over the Internet or stored on our computers. This makes your card details completely undecipherable by anyone except us. And as soon as the order has been processed, your card details are automatically deleted from our computer.

Some more information regarding payment for orders

When you submit your order to McLaren’s, we do not immediately charge your card while you are still online. Only when we are satisfied that we can fulfil your order promptly and accurately with no unexpected increase in the prices will we charge anything at all to your card.

Title to Goods

McLaren’s retains full title to all goods supplied until paid for in full including delivery charges. In the event of the customer’s insolvency McLaren’s reserves the right to reclaim goods for which full payment has not been made.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly by electronic means. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

Drawings, photographs and descriptions

We aim to provide as accurate information as possible. All drawings, photographs, video clips, descriptions and advertising are issued or published solely to provide you with an approximate idea of the products they describe. They do not form part of the contract between you and us.

VAT and other taxes

Books and sheet music are zero-rated for VAT in the UK; most other items are rated at 20%. Where VAT is applicable, it will be charged at UK rates even if you have registered as a non-UK customer. We are required by law to collect VAT at UK rates on orders despatched to countries within the European Union.

Import duties

If you order products from our site for delivery outside of the EU, they may be subject to export/import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of such charges. You should also be sure to comply with all applicable laws and regulations of the country for which the products are destined – we will not be liable for any breach by you of any such laws.

Delivery and Carriage

Items in stock are usually despatched within one to two working days (Monday-Friday) after the order has been received.

If an item is out of stock you will be notified within three working days & asked if you wish to cancel or wait for stock to arrive. Orders are despatched via courier, Royal Mail or by specialist carrier. Actual delivery time cannot be guaranteed and may be anytime between 8am and 6pm (Monday-Friday). McLaren’s uses national couriers, specialist carriers and Royal Mail, who make every effort to deliver your order as quickly and reliably as possible.

Delivery Of Large Items To UK Addresses Outside Mainland UK:

For orders which include large items (eg Clavinovas, large keyboards etc) where you live outside of mainland UK (eg Northern Ireland, Scottish Islands, Scilly Isles, Isle of Man, Isle of Wight, Channel Islands) please contact us and we will be happy to provide a quote for delivery. It is possible to place an order for the item, in order to reserve it, but where the delivery charge appears as zero you may incur a further charge for delivery. Prices will depend on the actual destination address.

Delivery Damages

Orders shipped by courier (excluding those for sheet music items) are insured by McLaren’s against loss or damage until signed for by you. Please note that it is your responsibility to inspect the item(s) for external damage before you sign for delivery. If the outer box is badly damaged, please make a note of this on the delivery note and refuse to accept delivery. After signing for the item(s), please open them as soon as possible and check the contents. If unsure, sign for goods as unexamined. Missing or damaged items must be reported within 24 hours of delivery in writing. (Please also view our Returns Policy.)

Delivery Address

McLaren’s operates in strict compliance with UK anti-fraud and card protection legislation and guidelines. When paying by credit or debit card, we will only deliver to an address already registered with your card issuer, usually the card statement address. All transaction information you enter is sent via our secure server to your own card issuer for authorisation and authentication. If the details do not match exactly, the card issuer will advise us to cancel the order.

Non-delivery of goods

If your goods are not delivered to you within 14 days of the despatch date you must notify us immediately, otherwise we cannot accept responsibility for the lost goods. You will be notified of the despatch date by email shortly after we have received your order.

Expected Delivery Times

Orders are normally supplied directly from stock. However, delivery times will be affected by the store and warehouse opening hours. Where possible we have tried to indicate the expected despatch times for all products. For any item not in stock, we will try to despatch it within the time indicated on the product page, but there may be circumstances outside our control that may cause a delay (e.g. non-availability of product from our suppliers etc).

Prices

The prices published on McLaren’s website apply only to orders placed over the Internet. Prices in our Glasgow store may vary.

From time to time there will be errors in pricing caused either by our mistake or by errors in the data sent to us by manufacturers and publishers. If this means that your order would cost more than anticipated we will check with you by email before processing your order.

Returns and Cancellation

If the goods you receive are faulty please return them to us in their original condition within 14 days and we will either repair or replace them, or refund the cost of the goods. If the goods you receive are not what you ordered, please return them to us in their original condition within 14 days and we will either replace them with the goods you ordered, or refund the cost of the goods and carriage. In addition to the above, you may in most cases return any goods within 14 days of receipt without giving any reason. However there are a few unavoidable exceptions to this, as follows:

Digital pianos and electronic keyboards, amplifiers and all electronic products can normally only be returned if they have not been removed from their original packaging and/or assembled, since assembly and disassembly makes these items very obviously “used”.

Please call us before returning any goods.

You are responsible for the cost and safe return to McLaren’s of any unwanted goods. Please ensure that you retain proof of sending any item for return. Alternatively, McLaren’s can arrange collection. You are responsible for the direct cost of collection of such goods by McLaren’s. You must take reasonable care of the item and must return it, and all packaging and accessories, in original condition. After we receive the item plus all packaging and accessories in original condition, we will refund the purchase price of the item in full, as soon as possible and within not more than 30 days. Delivery charges are not refundable.

The consumer shall not be entitled to a full refund of the product purchase price if he/she does not take reasonable care of the Goods either prior to cancellation of the Contract or, following cancellation, while the Goods remain in the possession of the consumer. For the purposes of this clause, a consumer shall be deemed not to have taken reasonable care of the Goods if such Goods are not returned to McLaren’s packed in their original box, with all accessories, manuals and cables, or if the Goods or the internal or external packaging is defaced or damaged in any way.

McLaren’s cannot, and does not, in any way attempt to warrant the suitability of goods for a particular purpose. It is your responsibility to carefully check specifications, sizes and compatibility before ordering. If you are unsure of the size, suitability or compatibility of an item, please contact McLaren’s before placing your order. It is your responsibility to ensure that you are purchasing the correct product.

Goods purchased from McLaren’s are not sold on a trial basis.

If a refund is due to you it will be made expeditiously and within 30 days.

Warranty and Guarantees

The minimum warranty / manufacturers guarantee for products sold on this site us for a period of one year. Many products have a longer warranty period and this will be stated on the page where such products are advertised.

Privacy

We are committed to protecting your privacy.

All the information you give us is collected lawfully and in accordance with the Data Protection Act 1998 and is collected only for the purpose of processing your order and collecting information for our own marketing purposes. All the information you give us when you register, or when you place an order, is treated as confidential and we will not share any of this information with any third party.

McLaren’s will never sell, nor divulge your email address, or personal information to any third party, except specifically to our delivery agents, working on our behalf to complete delivery. When you add items to your shopping basket and proceed to the checkout, we capture the personal information you supply. This is required to record and verify your name, address and card details, without which we would not be able to process your card payment, nor deliver the goods to you.
